Warranties

A. Window Warranty
- The vinyl windows installed on the property at the address specified in this Warranty are warranted by the manufacturer, Badger Custom Windows, Inc., to the Property Owner as follows subject to the terms and conditions of this warranty:

• Main Window Frame and Sash Frame are warranted against blistering, corroding, flaking or peeling, for a limited lifetime to the original property owner, from the date of installation. For the first year that this warranty is in effect, Badger Custom Windows, Inc. will repair or replace, at its option, the defective parts or components involved (labor and materials included). After the first year this warranty is in effect, Badger Custom Windows, Inc. will repair or replace, at its option, the defective part or component involved (labor cost not included). This warranty shall remain in effect on the main windows and sash frames only if normal cleaning practices as noted later in this certificate are followed periodically.


• Insulating Glass Components Unit of the window is warranted for a period of 30 years from date of installation against material obstruction of vision resulting from film formation or dust collection between interior glass surfaces, caused by failure of the hermetic seal. For the first year that this warranty is in effect, Badger Custom Windows, Inc., will repair or replace, at its option, the defective parts or components involved (labor and materials included). In the second through the 10th year this warranty is in effect, Badger Custom Windows, Inc, will repair or replace, at its option, the defective parts or components involved (labor costs not included). Should insulating glass unit fail after year 10, as a result of defects described above, then Badger Custom Windows will charge you a fixed percentage of the company’s selling price for insulated glass at that time, according to the following formula:


Years 11-15 -60%

Years 16-20 -70%

Years 21-25 -80%

Years 26 to 30 -90%


• Component Mechanical Parts of the Window-locks, keepers, and operators are warranted against failure caused by defects in material and workmanship for a Limited Lifetime to the original property owner from the date of installation, Badger Custom Windows, Inc. will repair or replace, at its option, the defective part or component involved (labor costs not included).


• Bay and Bow Windows - The component window units are warranted for a limited lifetime, to the original property owner, from the date of installation. For terms of the warranty see: Main Window Frame and Sash Frame Section. All wood members of the Bay or Bow unit are warranted for a period of one year from the date of installation. The warranty is null and void if the wood members are not properly sealed with a protective coating or paint, varnish or an equivalent product.


• Property Ownership Status - If the building in which the Badger Custom Windows are installed is owned by an entity other than an individual resident owner, whether by a corporation, partnership, an unincorporated association, or by a government or public entity, including without limitation, a church or school, then the warranty period shall be a Ten (10) Year Limited Warranty from the date of window installation, applicable to all window parts and components, under the prorated basis of this Warranty, with labor at no charge to Property Owner on warranted work for a one (1) year period, from date of window installation, and subject to all other terms and conditions of this Limited Warranty.

 

B. Conditions Not Covered By This Warranty - This Warranty does not cover breakage of glass or torn screens from any cause whatsoever. This Warranty only covers the conditions specified herein and does not include defects or damage attributable to installation, normal weathering, atmospheric pollutants or mildew, or caused by misuse, abuse, building settlement or structural failure of walls or foundation, or if subjected to stresses, resulting from localized heat which caused excessive temperature differential over the glass surfaces or edges or any other causes beyond our control and unrelated to the manufacturing process.


This Warranty does not apply if the windows are painted, varnished, or coated with any substance other than the manufacturer’s original finish, or if expanding foam insulation is used.
Condensation on windows occurs as the natural result of humidity within the house or building area, and changes in interior/exterior temperatures, and does not indicate a defect in the window and is not included in this Warranty.


This Warranty is valid only if windows manufactured by Badger Custom Windows, Inc. are used but shall be void if window accessory products not manufactured or approved by Badger Custom Windows, Inc., are installed which cause defects to occur in the windows.


This Warranty does not cover any defects or damage attributed to earthquakes, hurricanes, tornado, cyclone, hale, lightning, fire, acts of God, flood, wind-borne objects, ice, hail, or weather of a catastrophic nature as defined by the United States Weather Bureau or harmful chemicals, fumes, or vapors directly applied to the window or in the atmosphere.


C. Claims and Remedies - If the windows do not conform to this Warranty during the time period specified in the provisions of this Warranty, then Badger Custom Windows, Inc. agrees at its option to repair or replace any defective part or components. This Warranty does not include labor costs except where specifically stated, and Badger Custom Windows, Inc. will not be responsible for any costs incurred in the removal or replacement, installation or reinstallation of the window or any part or component of the window.


IMPORTANT: Any claims under this Warranty must be made within thirty (30) days after the defect was first discovered or reasonably could have been discovered. All Warranty claims must be sent to: Badger Custom Windows, Inc., 2728 Davey Street, Eau Claire, WI 54703. Attn. Warranty Claims Department and should describe the defect claimed, and contain a copy of proof of purchase. If your claim falls within this Warranty, Badger Custom Windows, Inc. will instruct you to ship the defective part or component to Badger Custom Windows, Inc., transportation charges prepaid. Badger Custom Windows, Inc., will pay transportation charges back to the Property Owner’s premises.

Badger Custom Windows, Inc. reserves the right to discontinue or change any window as manufactured. If the part or component of the originally manufactured window is not available, and Badger Custom Windows Inc. determines to make replacement, Badger Custom Windows, Inc. shall have the right to substitute such part or component designated by Badger Custom Windows, Inc. to be equal quality.


THE WARRANTY STATEMENTS CONTAINED IN THE CERTIFICATE SET FORTH THE ONLY EXPRESS WARRANTIES EXTENDED BY BADGER CUSTOM WINDOWS, INC. FOR THE WINDOWS, AND THE PROVISIONS OF THIS CERTIFICATE SHALL CONSTITUTE THE PROPERTY OWNER’S EXCLUSIVE REMEDY FOR BREACH OF THE WARRANTY GIVEN UNDER THIS CERTIFICATE, BADGER CUSTOM WINDOWS, INC. SHALL NOT BE LIABLE TO THE PROPERTY OWNER FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF ANY WRITTEN OR IMPLIED WARRANTY ON THE WINDOWS.

Some states do not allow limitation on how long an implied warranty lasts, and some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.


Double Limited Lifetime Warranty


This warranty may be transferred from the original purchaser to a subsequent owner for a period of 30 years from the date of installation as determined by proof of purchase provided Badger Custom Windows receives notification of transfer of property within 30 days of transfer of title, failure to notify Badger Custom Windows relieves Badger Custom Windows of any further obligation. To complete the transfer of Warranty, the former owner must sign this certificate below and return it to Badger Custom Windows, Inc.,
2728 Davey Street, Eau Claire, WI 54703. A new certificate validated as transferred will be returned to the new owner.


Windows and Condensation

Q. Do windows cause condensation?
A. Windows are not a cause, as such. They provide a ready medium on which the vapor can condense. But the primary cause of condensation is excessive moisture in the air. Windows are simply indicators of that moisture.


Q. Why do I see condensation on my windows and patio door first?

A. Condensation is generally seen first on windows and patio doors because they tend to have the lowest temperature on any of the visible surfaces in the house.


Q. Are windows the only place condensation is forming?

A. Possibly not. There’s a point between exterior and interior walls that’s just as cold as the inside window surface. Chances are, if you can see condensation on your windows, it’s also forming between the walls. Room-side surfaces of exterior walls are normally warmer, but occasionally condensation occurs on cold spots such as nail heads and in the corners of
outside walls and closets. That’s because insulation is weaker and air circulation is restrict ed in those areas.


Q. What causes condensation on windows and patio doors?

A. Remember: cool air can’t hold as much moisture as warm air can. So when the warm, moist air of the room comes into contact with the cold glass surface, some water vapor which the cooled air can no longer hold is deposited on the glass. Condensation can also occur when the flow of warm room air over window surfaces is restricted.


Q. Does the amount of condensation depend on the window type?

A. Sometimes. Angle bay or bow windows, for example, usually experience more condensation than other window styles. This is because inside air circulation around those window types is usually more restricted. And, since they hang away from the insulated house walls, bays and bows could be a few degrees cooler in temperature. To diminish excessive condensation, it’s smart to insulate between the window head and platform, as well as between the seat and platform. In extremely cold climates, additional insulation above and below the window platform may also be necessary. As a secondary measure, placing a common electric fan near the window to promote air circulation may be helpful.


Q. Do drapes and window shades cause window condensation?

A. Drapes and other window coverings don’t cause window condensation, but they can contribute to the problem by restricting the flow of warm room air over the glass surface. Therefore, condensation is more apt to occur when drapes are closed and shades are pulled down. Today’s heavily insulated drapes and tighter shades can contribute to the problem even more.


Q. What damage can excess window condensation cause?

A. It can cause the paint to peel from the trim or stain the inside. Water can run down into and cause dampness around the window frame. It can sometimes cause paint to peel on the outside of the structure.


Q. Are there any cases where window condensation is only temporary?

A. Yes, there are primarily three: new construction or remodeling; the beginning of each heating season; and quick changes in temperature.

• Wood, plaster, cement, and other building materials used in new construction and remodeling produce a great deal of moisture. When the heating season starts, this moisture will gradually flow out into the air in the home. It will usually disappear during the first heating season and not cause any further trouble.

• At the beginning of the heating season, there may be a certain amount of temporary condensation. During the humid summer your house will have absorbed some moisture. After the first few weeks of heating, it will dry out, and you’ll have fewer condensation troubles.
• Sharp, quick drops in temperature can also create temporary condensation problems during the heating season.


Summary

Q. What steps can I take to reduce excessive humidity and control window condensation in my present home?
A. Recognize that the best way to stop condensation is to reduce the moisture in the inside air.

Be sure that attic and crawl spaces are properly ventilated. Add a vapor barrier to cover the earth in the crawl space.

Be willing to try living with low humidities.

Eliminate any controllable sources of moisture in your home.

In winter, provide more controlled ways for moist inside air to get out. Run kitchen or other ventilating fans longer and more often than you normally do.

If troublesome condensation persists, see your heating contractor about an outside air intake for your furnace (required by some state building codes on all new residential construction), about ventilation of gas-burning heaters and appliances, or about installation of ventilating fans. Remember, the best way to avoid condensation is to reduce the humidity of the inside air.
